Website Terms of Use

Orange County Foot & Ankle Group

1. About these Terms

Orange County Foot & Ankle Group (the Practice, we, us, or our) provides ocfeet.com and the website features covered by these Terms of Use. These Terms explain permitted website use, the limits of general health information, and how website features relate to care, privacy, and other agreements. Feature-specific provisions apply only when that feature is offered.

Please read these Terms before using the website. When we ask you to accept them for a particular feature, that acceptance governs as permitted by applicable law. Continued website use is subject to these Terms only to the extent legally enforceable; merely visiting a page does not supply a consent or agreement that requires a separate affirmative action.

2. General information and medical emergencies

Public articles, videos, FAQs, educational materials, and general automated responses are for informational and educational purposes. They are not individualized medical advice, diagnosis, or treatment, and do not replace consultation with a qualified clinician who can evaluate your circumstances. Do not disregard professional advice or delay seeking care because of website content. Results described in testimonials, images, or examples are individual experiences, not promises of a particular outcome.

If you believe you have a medical emergency, call 911 in the United States or your local emergency number, or seek emergency care immediately. Do not use website forms, chat, appointment requests, or the general contact email for emergencies. These channels are not emergency services and may not be monitored continuously.

3. Patient relationships appointments and care

Browsing public pages, using a general chatbot, or sending an initial inquiry does not, by itself, establish a clinician-patient relationship. Such a relationship may arise through actual professional interactions under applicable law; these Terms do not negate an existing relationship or duties arising from it. Individualized care communications through an established clinical service are governed by that service and applicable professional obligations.

An appointment request is a request unless the scheduling process expressly confirms a booking. Availability, suitability for a service, and acceptance as a new patient may require further review. A confirmation of an appointment does not guarantee a particular treatment or outcome. Cancellations, missed-appointment charges, and other practice policies must be communicated separately; these Terms create no such fee.

If we offer telehealth, patient portals, online intake, prescription requests, or payment services, separate clinical consents, identity verification, financial policies, and feature-specific terms may apply. Telehealth availability depends on professional licensure, your location, clinical appropriateness, and applicable law. A request does not guarantee a prescription. Website descriptions of insurance participation, fees, or coverage do not guarantee an insurer's payment or determine your final responsibility; obtain confirmation from the Practice and your plan.

4. Health information and confidentiality

Use the secure patient channel designated by the Practice for medical records, clinical questions, or sensitive details. Do not place health information in public comments or send unnecessary medical details, payment-card information, or credentials through general email or public forms. This request does not waive protections that apply to information you actually submit.

Our Website Privacy Policy is separate from a HIPAA Notice of Privacy Practices. Where HIPAA applies, the Notice of Privacy Practices explains protected health information practices and patient rights. Applicable confidentiality law continues to govern regardless of whether information arrives through a public page or a patient portal.

Accepting these Terms, submitting a form, or accepting cookies does not itself constitute a HIPAA authorization, consent to treatment, release of medical records, permission for testimonial advertising, or authorization for tracking-related disclosures of protected health information. Any legally required authorization or consent must be obtained through the appropriate separate process. Contact privacy@toppractices.com for help locating the relevant notice or secure contact method.

5. Website access and permitted use

You may use the website for lawful purposes, including learning about us, making genuine inquiries, and using features we make available. You must have legal authority to act for another person or organization when you submit information or requests on their behalf. Parents, guardians, and authorized representatives must respect any legal limits on their authority and on access to another person's information.

If a feature requires an account, provide accurate information, protect your credentials, and notify us at privacy@toppractices.com if you suspect unauthorized access. Do not share access with someone who is not authorized to use it. Nothing in these Terms makes you responsible for activity that applicable law does not permit us to attribute to you. Additional eligibility and identity checks may apply to particular features.

6. Website content and intellectual property

Unless otherwise identified, the website's original text, design, branding, photographs, and other materials belong to us or our licensors and are protected by applicable intellectual property laws. You may view the website and save or print reasonable portions for your personal use or internal evaluation of our services, retaining relevant ownership notices.

Other reproduction, commercial redistribution, modification, or use of our branding requires permission unless applicable law permits it. No ownership rights transfer to you. These Terms do not restrict fair use, lawful accessibility adaptations, or other uses protected by law. You may link to publicly available pages without suggesting an endorsement, affiliation, or sponsorship that does not exist.

7. Prohibited activities

Do not use the website to commit fraud, impersonate another person, submit unlawful threats, infringe another person's rights, distribute malicious code, or intentionally disrupt services. Do not attempt to obtain unauthorized access to accounts, private records, or restricted systems, bypass access controls, or collect personal information without authorization.

Do not submit spam or use automated requests in a way that overloads the website or defeats technical restrictions. These restrictions do not prohibit assistive technology, ordinary search-engine indexing consistent with site permissions, authorized security testing, or conduct protected by law. To report a suspected vulnerability, contact privacy@toppractices.com with enough information to explain the issue without exposing private records or exploiting it further.

8. Submissions and feedback

Provide information you are authorized to share and avoid sending unnecessary sensitive information through public forms or public comments. You remain responsible for the content you submit, subject to applicable law. We do not acquire ownership of your submissions simply because you send them to us.

You permit us to use a submission as reasonably necessary to receive it, respond, and provide the feature you requested, subject to the Website Privacy Policy and applicable law. If you intentionally submit material for public display through an available feature, you grant a nonexclusive permission to display and technically format that material for that purpose. This permission does not authorize unrelated advertising use of private messages, images, or sensitive information.

We may moderate publicly submitted material for unlawful content, spam, personal information, or violations of these Terms. Nothing here prohibits honest reviews, lawful criticism, reporting concerns to authorities, or exercising protected rights. You do not transfer ownership of a review or incur a penalty merely for giving a negative review.

9. Privacy and separate permissions

Our Website Privacy Policy explains our information practices and privacy choices. These Terms do not replace that policy or any notice required by law. Website use, acceptance of these Terms, and permission for optional marketing or tracking are separate matters. Where law requires a particular consent, authorization, or opt-out mechanism, these Terms do not supply or override it.

10. Email text messages and electronic records

When you contact us, we may respond about your inquiry through an appropriate channel, subject to applicable law and your communication preferences. Marketing messages require whatever permissions the law requires. Providing a telephone number or accepting these Terms does not by itself enroll you in a recurring promotional text program. Consent to promotional calls or texts is not a condition of purchasing goods or services.

If we offer an SMS program, its enrollment disclosures and any separate messaging terms describe its purpose and operation. Message frequency depends on the program, and message and data rates may apply. Follow the program's STOP or HELP instructions when available, or contact privacy@toppractices.com for assistance. You may revoke consent through other reasonable methods required by law. Delivery may be delayed or fail. Use the unsubscribe method in marketing emails to stop those emails; necessary transactional messages may still be sent as permitted by law.

If a transaction requires an electronic signature or electronic delivery consent, we will present the applicable process and disclosures separately. These Terms do not waive a right to paper records or supply a legally required electronic-delivery consent merely because you visited the website.

11. Third party services and links

The website may link to or incorporate services such as scheduling, payments, maps, videos, or external resources. Separate provider terms and privacy notices may apply to your use of those services. A link alone does not imply our endorsement of all content on the linked site. Review the relevant notices before using a service or submitting information.

We do not control independent third-party websites, but this provision does not eliminate our responsibilities for vendors we engage, information we disclose, or access to services we provide through those vendors. Contact privacy@toppractices.com if an integrated feature causes a problem.

12. Automated features and artificial intelligence

If the website offers an automated assistant, generated summary, translation, or recommendation, it may contain errors, omit context, or misunderstand a request. Do not assume that an automated response has been reviewed by a person or that it confirms a booking, purchase, or other commitment unless the applicable process expressly confirms that result.

Use the stated human contact method when a response is unclear or consequential. Do not provide sensitive information to an automated feature unless it is specifically designated to receive it. Any required disclosures and permissions for recording, automated communications, or processing personal information remain separate. These Terms do not authorize undisclosed training of AI systems on your information.

Automated general website assistance does not provide a medical diagnosis or substitute for a clinician. These Terms do not authorize automated clinical decisions or change the Practice's professional duties.

13. Availability and website warranties

We may change or discontinue website features, perform maintenance, or address security issues. We do not promise uninterrupted access, compatibility with every device, or that all general website material will always be complete or current. Contact us to verify information important to your decision.

To the extent permitted by applicable law, the general informational website and its content are provided as available, without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This provision does not override express commitments in a separate agreement, mandatory consumer guarantees, accessibility duties, or responsibilities that applicable law does not allow us to disclaim.

14. Limits on website liability

To the extent permitted by applicable law, we are not liable for indirect or consequential losses, such as lost profits, arising from use of or inability to use the general informational website. This limitation concerns website use and does not disclaim liability for professional services, bodily injury, fraud, intentional misconduct, gross negligence, unlawful discrimination, or violation of privacy or other rights where liability cannot lawfully be limited.

Some jurisdictions do not allow certain limitations. In those jurisdictions, this section applies only to the extent permitted. These Terms impose no blanket monetary cap and do not shorten a legally available claim period. They do not limit remedies or obligations that cannot be waived.

15. Restriction of website access

We may restrict a website feature or account when reasonably necessary to address misuse, security threats, legal requirements, or a material violation of these Terms. Where appropriate and legally permitted, we will provide notice and a way to seek assistance. Restrictions must be applied consistently with applicable law and existing contractual obligations.

An access restriction does not erase accrued rights, outstanding obligations, lawful record-access rights, or rights to refunds or other remedies. Contact privacy@toppractices.com if you believe access was restricted in error or you need an accessible way to complete a task.

Restriction of a website account does not by itself terminate a clinician-patient relationship or excuse the Practice from continuity-of-care, medical-record, or patient-notification duties.

16. Applicable law and resolving concerns

Applicable law determines your rights and the enforceability of these Terms. Mandatory consumer protections and other nonwaivable rights available to you remain in effect. These Terms do not select an exclusive state law or court, require arbitration, waive jury or class-action rights, or require you to contact us before exercising a legal right.

We welcome an opportunity to address a concern at privacy@toppractices.com. You may also contact an appropriate regulator or use any dispute-resolution process available under applicable law. A separately accepted agreement may contain additional lawful terms for a particular service or transaction.

17. Changes and interpretation

We may revise these Terms to reflect changes in website features or applicable requirements. Revisions operate prospectively. For material changes affecting an ongoing account or contractual relationship, we will provide any notice and obtain any agreement required by law. Merely posting revised wording does not override an existing contract or establish assent where the law requires more.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not automatically waive it for another. No provision creates a third-party beneficiary right unless expressly stated. These Terms address the website; separate agreements govern the particular services and transactions they cover.

18. Accessibility and contact

For questions about these Terms, website problems, accessibility assistance, or a request for a copy of these Terms, contact Orange County Foot & Ankle Group at privacy@toppractices.com. You may also use the contact options listed on ocfeet.com. Our Accessibility Statement explains how to report a barrier or request help using the website.
